Terms of Service

1. About These Terms
These Terms of Service ("Terms") govern your use of:
- The Kenaz Training website at kenaztraining.ca and any related pages or subdomains (the "Website"); and
- The services provided by Kenaz Training Ltd ("Kenaz Training," "we," "us," or "our"), including in-person and online training and rehabilitation services (the "Services").
By using our Website or Services, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.
"You" means the individual using the Website or Services, or, where applicable, the parent or legal guardian acting on behalf of a minor.
2. Services and Scope of Practice
Kenaz Training provides personal training, kinesiology, ICBC active rehabilitation, injury rehabilitation, post-surgical rehab, performance training, youth athletic training, nutrition coaching, seniors fitness, wellness training, and related exercise-based programs. Services are delivered by certified trainers and/or registered kinesiologists, in person at our Langley facility or online on an appointment-only basis.
We do not:
- Diagnose medical conditions;
- Provide medical treatment;
- Prescribe medications.
Our Services are not a substitute for the care of a physician, physiotherapist, or other regulated healthcare professional. You should consult your own healthcare provider before starting any exercise or rehabilitation program.
We may modify, suspend, or discontinue any Service at any time with reasonable notice.
3. Eligibility and Health Disclosure
By booking or participating in a Service, you confirm that:
- You are at least 18 years of age; or
- You are a parent or legal guardian enrolling a minor and accept these Terms on their behalf.
You also confirm that:
- You have disclosed any known medical conditions, injuries, surgeries, physical limitations, medications, or other health concerns that may affect your ability to safely participate;
- You will update us immediately if your health status, symptoms, or medications change;
- You understand that failure to disclose relevant health information may increase your risk of injury.
We reserve the right to refuse, modify, or discontinue Services if we have reasonable concern for your safety or the safety of our staff.
4. Bookings, Cancellations, and Attendance
Booking
Sessions must be booked in advance through our online booking system or by contacting us directly. Your appointment is confirmed when you receive confirmation from Kenaz Training.
Cancellation Policy
- At least 24 hours' notice is required to cancel or reschedule a session without charge.
- Cancellations with less than 24 hours' notice, or no-shows, may be charged the full session rate at our discretion.
- Repeated late cancellations or no-shows may result in a requirement to pre-pay for future sessions.
- If Kenaz Training cancels a session, we will reschedule at no additional cost to you.
ICBC Active Rehab
ICBC-funded sessions are subject to ICBC rules and pre-approval. Missed or late-cancelled sessions may not be billable to ICBC and may become your responsibility. We will explain the applicable requirements when your program begins.
5. Payment and Packages
Payment is due at the time of service unless a pre-authorized billing arrangement or third-party billing (such as ICBC or WorkSafeBC) is in place. We accept payment by credit card, debit, and electronic funds transfer. All prices are in Canadian dollars and subject to applicable taxes.
- Packages and prepaid sessions are non-transferable.
- Expiry or usage terms for packages will be communicated at the time of purchase.
- Refunds are provided only at our discretion and in accordance with BC consumer protection law.
If a third-party payer stops or denies coverage, you are responsible for any unpaid balances for Services you choose to continue.
6. Assumption of Risk and No Guarantees
Physical exercise, rehabilitation, and related activities involve inherent risks, including but not limited to:
- Muscle soreness, sprains, and strains;
- Joint injuries;
- Cardiovascular events;
- Aggravation of existing conditions.
By using our Services, you acknowledge and voluntarily accept these inherent risks and confirm that you have had, or have had the opportunity to have, a medical assessment to confirm your fitness to participate.
We do not guarantee specific outcomes, such as particular weight loss, performance gains, or pain reduction. Results vary from person to person based on many factors, including health status, adherence, and effort.
7. Limitation of Liability
To the fullest extent permitted by law, Kenaz Training Ltd, its owners, employees, contractors, and agents shall not be liable for any injury, loss, damage, or expense arising out of or in connection with:
- Your use of the Website;
- Your participation in our Services; or
- Your presence in our facility;
except where caused by our gross negligence or wilful misconduct.
Our total liability to you for any claim relating to the Services shall not exceed the amount paid by you for the specific Service giving rise to the claim in the 30 days prior to the event.
8. Photography, Video, and Media
We may occasionally photograph or video record our facility or sessions for internal training, quality assurance, or marketing purposes.
- We will always obtain your express consent before using any image or video in which you are identifiable in public-facing materials.
- You may withdraw consent for future use at any time by contacting us in writing.
You agree not to photograph, video, or audio record other clients or staff without their explicit consent.
9. Conduct in Our Facility
You agree to:
- Treat Kenaz Training staff, contractors, and other clients with respect;
- Follow all safety instructions given by your trainer or kinesiologist;
- Not attend sessions under the influence of alcohol or non-prescribed substances;
- Report any equipment damage or safety hazard to staff immediately;
- Not bring unauthorized guests into the facility.
We reserve the right to terminate Services and remove any person from our facility for conduct that is unsafe, disruptive, or in violation of these Terms, without refund of prepaid sessions.
10. Website Use and Content
The content on kenaztraining.ca, including text, images, logos, graphics, and downloadable materials, is owned by Kenaz Training or used under license and is protected by Canadian copyright and intellectual property law.
You may view and print content for your personal, non-commercial use. You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written permission, or scrape, data-mine, or use automated tools to extract content without consent.
Information on the Website is provided for general educational and informational purposes only. It is not medical advice and should not be relied on as a substitute for consultation with a qualified healthcare professional. We make reasonable efforts to keep information accurate and up to date, but do not warrant that all content is error-free. Pricing, service descriptions, and availability are subject to change without notice.
11. Communications, SMS, Email, and Automation
By submitting your information through our Website forms, Meta lead ads, or other channels, and by checking any consent box presented, you agree that Kenaz Training and its agents may contact you by phone, voicemail, SMS/text, email, direct messages, and website chat, including via automation tools, to respond to your inquiry, book and confirm appointments, and share information about our Services, subject to applicable law.
These communications are governed by our Privacy Policy. You can opt out at any time using the methods described in that Policy.
12. Privacy
Your personal information is collected, used, and disclosed in accordance with our Privacy Policy and applicable privacy laws. By using our Website or Services, you consent to our handling of your information as described in that Policy. Our Privacy Policy is available on our Website and forms part of these Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising out of or relating to these Terms, the Website, or the Services shall be subject to the exclusive jurisdiction of the courts of British Columbia, sitting in or near Langley, BC.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will post the updated Terms on this page with a revised effective date. Your continued use of the Website or Services after any changes means you accept the updated Terms.
