This Policy explains how Kenaz Training Ltd collects, uses, discloses, and protects personal information. We handle personal information in accordance with British Columbia's Personal Information Protection Act (PIPA) and applicable Canadian laws, including Canada's Anti-Spam Legislation (CASL) and the CRTC Unsolicited Telecommunications Rules. By using our Services or submitting your information, you consent to the practices described in this Policy.

This Terms of Use and Privacy Policy ("Policy") explains how Kenaz Training Ltd ("Kenaz Training," "we," "us," "our") collects, uses, discloses, and protects personal information when you:

  • Visit our website kenaztraining.ca and any related pages or subdomains (the "Website");
  • Submit information through our online forms, including Meta (Facebook/Instagram) lead forms and landing pages;
  • Communicate with us by phone, SMS/text, email, or through automated systems, including our AI voice and messaging agents (collectively, the "Services").

2. Personal Information We Collect

We may collect the following types of personal information:

a) Contact and Profile Information
Name, phone number, email address, mailing address, age, and other demographic information you choose to provide.
b) Fitness and Health-Related Information
Goals, preferences, and lifestyle info. (We do not provide medical advice; consult a physician before starting any fitness program.)
c) Payment and Transaction Information
Limited billing information related to purchases.
d) Technical and Usage Information
IP address, device type, cookies, and pixels for analytics.
e) Communications, Audio & Voice Data
Emails, SMS, and phone calls (including calls handled by our AI voice agent), which may be recorded and/or transcribed for responding to inquiries, quality assurance, and compliance.

3. How We Use Personal Information

We use personal information for purposes a reasonable person would consider appropriate in the circumstances, including to:

  • Provide, manage, and improve our coaching, training, and related services;
  • Respond to inquiries, schedule consultations, and manage your account;
  • Communicate with you about programs, offers, promotions, and updates (subject to your consent and applicable laws);
  • Run analytics, improve our Website and marketing; and
  • Maintain the security and integrity of our systems and comply with legal obligations.

4. Marketing Communications, SMS & Email (CASL)

When you submit your information and check the consent box on our forms, you provide express consent for Kenaz Training and our agents to contact you by phone, voicemail, SMS, and email, including the use of automated systems (AI voice agents and dialers). You can withdraw consent at any time by clicking "unsubscribe," replying "STOP" to texts, or telling a caller you wish to opt out.

5. Automated Calls, AI Voice Agent & ADAD Disclosure

We may use automated dialing systems and AI voice technology to contact you regarding assessments, program options, and reminders.

  • Identification: At the start of each automated call, we will identify our business and the purpose of the call.
  • Calling Hours: Automated calls will only be made during permitted CRTC hours: 9:00 AM to 9:30 PM (weekdays) and 10:00 AM to 6:00 PM (weekends), based on your local time.
  • Internal Do-Not-Call List: You can tell the caller at any time, "Stop calling me" or "Remove me from your list." We will process this request and cease marketing communications to your number within 14 days, and your number will remain on our internal do-not-call list for at least three years and 14 days, in line with CRTC rules.

Call Recording and AI Agent Consent: By accepting these Terms and Conditions, you consent to interacting with Kenaz Training's artificial intelligence voice agent and to the recording of all calls with our AI agent for quality assurance, training, and monitoring purposes. Our AI agent will identify itself at the beginning of each call. You may withdraw your consent at any time by ending the call or contacting us directly at info@kenaztraining.ca, though withdrawal may limit our ability to provide certain services.

6. Cookies, Tracking & Interest-Based Advertising

We use tracking technologies to understand usage patterns and deliver relevant ads. You can adjust your browser settings to refuse cookies, though some site features may not function properly as a result.

7. Sharing and Transfers of Personal Information

We share information with service providers (CRM, AI platforms, email/SMS providers, hosting, analytics, payment processors) who are contractually required to protect your data and use it only to provide services to us. Some providers may store data outside of BC or Canada (e.g., in the USA), where it may be subject to local laws. We do not sell your personal information.

Our current key service providers include customer relationship management and marketing platforms, infrastructure providers, payment processors, and AI processing tools. For example, our core providers include Go HighLevel (CRM and marketing automation), and other hosting, analytics, and AI processing services that support the operation of our Website and Services.

8. Your Rights Under PIPA

Under BC's PIPA, you have the right to request access to your personal information, request corrections if it is inaccurate or incomplete, and withdraw consent to certain uses, subject to legal and contractual restrictions. To exercise these rights, contact us using the information in Section 11.

If we cannot fully comply with a request (for example, because we must retain certain records for legal or business reasons), we will explain why. If you are unable to resolve a privacy concern with us, you may contact the Office of the Information and Privacy Commissioner for British Columbia for further information.

9. Security and Retention

We use reasonable safeguards to protect your information and retain it only as long as necessary to fulfill the purposes outlined or as required by law. When information is no longer needed, we securely destroy, delete, or anonymize it.

10. Third-Party Websites and Social Platforms

We are not responsible for the privacy practices of third-party sites linked from our ads or Website. Their policies govern your use of those services.

12. Social Media Interactions & Comment-Triggered Direct Messages

When you interact with our content on Meta platforms (including Facebook and Instagram), such as by liking, following, or commenting on our posts or ads, we may receive certain limited information about you through Meta's tools and APIs. This may include your public profile name, username/handle, profile link, the content of your comment or message, and the date and time of your interaction.

If you comment using a keyword or otherwise request more information on one of our posts or ads, we may use automation tools that operate through Meta's official APIs ("comment bot") to send you one direct message in response to that specific interaction (for example, to deliver a link, resource, or booking page you requested). We do not use this automation to send unrelated or ongoing marketing messages unless you later provide consent through another form or by continuing the conversation with us.

Please avoid sharing sensitive health, medical, or payment information in social media comments or direct messages. If we require this type of information, we will direct you to a secure form on our Website or to another secure communication method.

You can stop receiving direct messages from us on these platforms at any time by replying to our message to tell us you do not wish to receive further messages, or by using the platform tools (such as blocking or unfollowing our account).

13. Automated Messaging & AI Assistants (DM, Chat, SMS)

In addition to our AI voice agent described above, Kenaz Training may use AI-based assistants and automation tools to help generate or deliver some of our written responses in direct messages, website chat, email, or SMS/text.

These tools operate under our instructions and are used to:

  • Acknowledge your inquiry and provide basic information;
  • Send you links to resources, applications, or booking pages; and
  • Follow up on a request you have made (for example, to confirm an appointment time or ask if you would like to speak with a coach).

Our comment bot and AI messaging assistant are configured to send only an initial direct message in response to your comment or explicit request. Any further direct messages for marketing purposes will be sent only where permitted by applicable law and, where required, after you provide the appropriate consent.

All automated messages are sent on behalf of Kenaz Training Ltd and may be monitored by our team. You can opt out of marketing communications at any time by using the unsubscribe options described in Section 4, by replying "STOP" to SMS/text messages, or by using the platform tools (such as blocking or unfollowing our account).

14. Data Access and Deletion Requests for Social Media and Messaging Data

In addition to the rights described in Section 8, you may request access to, correction of, or deletion of personal information that we control and that was collected through Meta platforms (Facebook and Instagram) or other messaging channels in connection with your interactions with us.

To submit a request, contact us at info@kenaztraining.ca or by mail at the address in Section 11. We will review and respond to your request in accordance with applicable laws. Please note that we cannot delete information that remains on third-party platforms we do not control (such as content or messages stored by Meta); you must manage or delete that information directly within your Facebook or Instagram account.

We may update this Policy from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Your continued use of our Services after any changes are posted means you accept the revised Policy.
